1. Agreement to Terms

By requesting, scheduling, or accepting towing or roadside assistance services (“Services”) from Tech Addicts Auto LLC, you agree to be bound by these Terms of Service and any applicable local, state, or federal laws governing vehicle towing and recovery in Virginia, Maryland, and Washington, D.C.

If you do not agree to these Terms, do not use our Services.

2. Services Provided

We provide professional towing and roadside assistance services, which may include:

  • Local and long-distance towing (where permitted)
  • Accident recovery and winch-outs
  • Jump-start services
  • Tire changes and air delivery
  • Vehicle lockout assistance
  • Fuel delivery

Service availability is subject to weather conditions, safety considerations, equipment availability, and legal restrictions in each jurisdiction.

3. Dispatch, Arrival Times, and Availability

  • Estimated arrival times are not guaranteed and may vary due to traffic, weather, emergency calls, or road conditions.
  • We reserve the right to refuse service when conditions are unsafe or unlawful.
  • Law enforcement, property owners, or municipal authorities may override or terminate service requests.

4. Pricing and Payment

  • Pricing is based on service type, vehicle type, distance, location, and difficulty of service.
  • Additional charges may apply for after-hours service, accident scenes, winching, or special equipment requirements.
  • Payment is due at the time of service unless a prior written agreement exists.
  • Accepted payment methods: Visa, Mastercard, Amex, Discover, debit cards, Apple Pay, PayPal, and Venmo.

Failure to pay may result in vehicle retention (where legally permitted), storage fees, or collection actions.

5. Authorization of Service

By requesting service, you represent and warrant that:

  • You are the legal owner of the vehicle, or
  • You are authorized by the owner or law enforcement to request service.

We are not responsible for disputes regarding ownership or authorization.

6. Vehicle Handling and Risk Acknowledgment

Towing and roadside assistance involve inherent risks. By using our Services, you acknowledge and accept those risks.

We are not liable for:

  • Pre-existing damage or mechanical failure
  • Damage resulting from hidden or undisclosed vehicle conditions
  • Items left inside the vehicle
  • Delays caused by traffic, weather, or external conditions beyond our control

We will exercise reasonable care during service, consistent with industry standards.

7. Personal Property

Customers are responsible for removing valuables before service. We are not liable for loss, theft, or damage of personal property left inside vehicles.

8. Storage of Vehicles

If a vehicle is towed to or stored at our facility:

  • Storage fees will begin accruing daily at posted rates.
  • Vehicles must be claimed within the timeframe required by applicable state or municipal law.
  • Vehicles unclaimed may be processed under applicable Virginia Code § 46.2 (towing and lien laws), Maryland Transportation Code, or D.C. towing and impound regulations, including potential lien sale procedures.

9. Cancellations

  • Cancellations made before dispatch may not incur charges.
  • If a driver has been dispatched or arrived on scene, a cancellation fee may apply.
  • Fees may vary depending on distance traveled and time spent.

10. Refusal or Termination of Service

We reserve the right to refuse or terminate service if:

  • The scene is unsafe (traffic, weather, violence, hazardous conditions)
  • The customer is abusive, threatening, or obstructive
  • Illegal activity is suspected or occurring
  • Law enforcement requests discontinuation

11. Limitation of Liability

To the fullest extent permitted by law in Virginia, Maryland, and Washington, D.C., our liability is strictly limited to the cost of the service provided.

We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to:

  • Loss of use of vehicle
  • Loss of income or business interruption
  • Mechanical issues arising after service

12. Indemnification

You agree to indemnify and hold harmless Tech Addicts Auto LLC, its employees, contractors, and agents from any claims, damages, or liabilities arising from:

  • Your misuse of services
  • False or unauthorized service requests
  • Vehicle ownership disputes
  • Violations of applicable laws or regulations

13. Compliance with Local Laws

This agreement is governed by the laws of:

  • Commonwealth of Virginia
  • State of Maryland
  • District of Columbia

Where conflicts exist, applicable local towing, consumer protection, and lien laws will take precedence.

14. Changes to Terms

We may update these Terms at any time. Continued use of our Services constitutes acceptance of the updated Terms.
